Tóm tắt

Permissioned blockchain promises port communities better traceability, document integrity, and coordination, yet deployment is constrained where data-protection, cybersecurity, electronic-transactions, contract, and competition law diverge across jurisdictions. This study develops a legal-responsive framework that translates regulatory requirements into governance and architectural choices for permissioned blockchain systems in port ecosystems. Combining doctrinal legal analysis, functional comparative synthesis, and design-science modeling, legal materials were coded against five analytical dimensions — data governance, contractual and evidentiary validity, accountability and liability, operational security, and competitive conduct — and compared across Singapore, the Netherlands and the European Union, and Vietnam. The framework places a Layer 0 necessity-and-viability screen (S1–S4) ahead of four coupled design layers. The necessity question is inherited from the do-you-need-a-blockchain decision frameworks; Layer 0 tightens it against the strongest non-replicated alternatives — a threshold-signed multi-party log and a sector interoperability standard — and adds institutional, economic, and legal tiers, so the screen can return the answer not to deploy. A bounded pilot scenario for release-order and gate-event coordination at Cat Lai Port translates the framework into measurable indicators and an ex-ante cost model, reported as design assumptions. Formative ex-post probes against nine real platforms, a Monte Carlo analysis of the cost rule, and a benchmark spanning both prior-art families returned one negative result: the necessity questions predict adopted designs but not survival. This forced a disclosed repair — the S4 viability question, stated in binding-commitment form — leaving the Cat Lai verdict conditional on those commitments. Naturalistic validation through deployment remains necessary.
